1. Agreement and provider
These Terms of Service ("Terms") are an agreement between you and FastCat Digital Labs LLC ("FastCat," "we," "us," or "our") for FastCat VPN, our website, and related services (collectively, the "Service"). By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and your account
You must be legally able to enter this agreement and meet the minimum age required where you live. You are responsible for accurate account information, protecting your credentials, and activity under your account. Do not share, sell, transfer, or create accounts through unauthorized automated means.
3. Limited license
Subject to these Terms, FastCat grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for lawful, non-commercial purposes. We retain all rights not expressly granted to you.
4. Acceptable use
You must not use the Service to violate law or the rights of others; distribute malware or spam; gain unauthorized access; disrupt networks; facilitate fraud, harassment, exploitation, or other unlawful activity; resell the Service without permission; or reverse engineer the Service except where applicable law permits it. We may restrict access to protect users and infrastructure or to comply with law.
5. Service availability
VPN performance and availability can vary by location, device, network, maintenance, third-party systems, and legal restrictions. We may modify, suspend, or discontinue features. The Service does not guarantee access to any particular website, online service, server, region, or content.
6. Subscriptions, cancellation, and refunds
FastCat may offer paid, automatically renewing subscriptions. Price, billing period, trial terms, and renewal information are shown before purchase. For purchases made through the Apple App Store, Apple processes billing and manages cancellation and refund requests under Apple's terms and policies. You can manage an Apple subscription in your Apple ID subscription settings and request a refund through Apple. Deleting the app or your FastCat account does not cancel an App Store subscription. 7. Ownership and feedback
The Service, software, branding, and content belong to FastCat or its licensors and are protected by applicable intellectual-property laws. If you provide feedback, you allow us to use it without restriction or compensation.
8. Disclaimers
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of uninterrupted availability, error-free operation, fitness for a particular purpose, or non-infringement. Rights that cannot legally be waived remain unaffected.
9. Limitation of liability
To the maximum extent permitted by law, FastCat will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our aggregate liability for a claim will not exceed the greater of the amount you paid us for the Service during the 12 months before the event giving rise to the claim or US$100. Some jurisdictions do not allow these limitations.
10. Suspension, termination, and deletion
You may stop using the Service and request account deletion at any time. We may suspend or terminate access for a material breach, security risk, fraud, legal requirement, or discontinuation of the Service. Please follow the instructions on our Delete Account page.
11. Apple-specific terms
When you download the app through the Apple App Store, these Terms are between you and FastCat, not Apple. FastCat, rather than Apple, is responsible for the app and support for it. To the maximum extent permitted by law, Apple has no warranty obligation for the app. Apple and its subsidiaries are third-party beneficiaries of this section and may enforce it. You must also comply with applicable Apple Media Services Terms and App Store rules.
12. Governing law and changes
Except where mandatory consumer law provides otherwise, Wyoming law governs these Terms without regard to conflict-of-law rules. We may update these Terms and will post the revised version here with an updated effective date. Continued use after an update takes effect means acceptance where permitted by law.
